Three Top Mercedes-Benz Dealers Sued For Patent Infringement

Penske Motorcars, House of Imports and Auto Stiegler Included in ActionLOS ANGELES - The David versus Goliath battle between Jim Feuling and DaimlerChrysler has entered round two. New developments include a lawsuit filed in Los Angeles Federal Court Central District against three of the largest Mercedes-Benz dealers in North America -- Penske Motorcars, House of Imports and Auto Stiegler. The lawsuit claims infringement of four U.S. Patents, false advertising, interference with contractual relations, plus eight additional charges concerning three-valve cylinder head technology. The basic analysis for direct patent infringement finds legal authority in 35 U.S.C. Section 271(a), which states: "Except as otherwise provided in this title, whoever without authority makes, uses, offers to sell or sells any atented invention within the United States or imports into the United States any patented invention during the term of the patent therefore, infringes the patent." Jim Feuling stated, "In the initial action in California Southern District, Mercedes-Benz/DaimlerChrysler attempted to avoid the key issue of patent infringement by creating a lawyer-fed paper storm of objections, motions and technicalities reminiscent of the OJ trial. DaimlerChrysler's attorneys have decimated a small forest with their bogus paperwork. They can delay, but they can't hide. DaimlerChrysler will very soon, face the sobering reality of four valid U.S. Patents with 110 individual claims. I look forward to my day in Federal Court." Victory for Feuling could result in a recall of all U.S. three-valve Mercedes-Benz vehicles for removal of cylinder heads, as well as treble damages and legal fees.
