Mercedes-Benz Dlr Defaults in Feuling's Patent Suit
VENTURA, Calif., Aug. 9 -- Feuling Advanced Technologies
today announced the federal court entry of default in its patent lawsuit
against Hoehn Motors Mercedes-Benz in San Diego. The action came August 4
from the United States District Court, Southern District of California for
Hoehn's failure to answer the patent infringement lawsuit filed by Feuling
Advanced Technologies.
"It appears that Hoehn Motors and Mercedes-Benz are not only ignoring the
United States patent laws but also the United States Federal Court. These
actions do not bode well for a foreign company advertising itself as a
trustworthy corporate citizen," according to Feuling President Jim Feuling.
"U.S. Code Section 271(a) states: 'whoever without authority makes, uses,
offers to sell or sells any patented invention, within the United States or
imports into the United States any patented invention during the term of the
patent therefore, infringes the patent.'"
Additional defendants beyond Hoehn and Mercedes Benz USA currently being
served include Mercedes-Benz USA International, Inc.; DaimlerChrysler AG;
DaimlerChrysler Financial Services North America (debis); Debis Financial
Services, Inc. d/b/a Affinity Services Division; GIGGO Car; Mercedes-Benz
Credit Corporation and DaimlerChrysler.
"When it comes to defending our patented technology, we are serious as a
heart attack!" Feuling said.
To date Feuling Advanced Technologies, Inc. has licensed 3-Valve
Technology to Ford Motor Co., Mazda, Jaguar, Aston Martin and Volvo. Further
