Moldflow Competitor Files Counter Claims; C-MOLD Allegedly Fearful that Moldflow May Obtain a Monopoly in the Industry

    LEXINGTON, Mass.--March 31, 1999--Moldflow Corporation announced today that in response to Moldflow's lawsuit against Advanced CAE Technology (d/b/a C-MOLD) and its employee, Dr. Leonid K. Antanovskii, C-MOLD has filed counterclaims against Moldflow. The counterclaims are based on alleged violations of various federal anti-trust statutes, and allege, among other things, that Moldflow is attempting to "drive C-MOLD out of business thereby giving Moldflow a monopoly on the industry." C-MOLD also alleges that Moldflow has "damaged C-MOLD in that C-MOLD has lost business and has been forced to expend time, effort, and money to respond."
    Marc Dulude, President and CEO of Moldflow Corporation, commented that, "We are disappointed that C-MOLD attempted to close the technology gap by using our trade secrets and that they have chosen to respond to our legitimate legal actions in this way." As previously reported, Dr. Antanovskii worked on 3D technology at Moldflow for approximately two years and, at the time of his departure, misled Moldflow concerning his future employment. "When we became aware that Dr. Antanovskii was working on C-MOLD's 3D product, we realized that his use and disclosure of Moldflow trade secrets was inevitable and we had no choice but to initiate appropriate legal action," Dulude explained.
    Concluding that Moldflow was likely to succeed in the case, the Federal Court preliminarily enjoined C-MOLD and Dr. Antanovskii from using or disclosing Moldflow secret information. The Court also preliminarily enjoined Dr. Antanovskii from working on C-MOLD's 3D product. C-MOLD thereafter "temporarily suspended" the activities of the Full 3D Simulation Group that it introduced in February of this year.
    With respect to the counterclaims, Moldflow denies any wrongdoing and intends to vigorously defend itself against these charges. "Moldflow maintains the highest ethical standards in the industry and welcomes any legitimate competition that provides enhanced products and offerings which benefit customers," continued Mr. Dulude. "The root of Moldflow's industry-leading growth comes from releasing innovative products that meet and exceed customer expectations and we want to make it easy for all potential customers, including C-MOLD users, to take advantage of the more modern technologies available from Moldflow. We are unaware of any specific damage C-MOLD has sustained by having to respond in the market to product deficiencies or to legitimate, healthy competition. We are, however, certain that customers are getting better products for less money than they have historically seen as a result of this high level of competition. We are also intrigued that C-MOLD claims to be `the premier developer of simulation software for the plastics industry' in their marketing materials while alleging to be fearful that Moldflow may obtain a monopoly in the industry."
