Simula, Inc. Seeks Injunction Against Autoliv, Inc.

PHOENIX, Feb. 26 -- Simula, Inc. announced that
it has filed a complaint in United States District Court for the District of
Arizona against Autoliv, Inc. , seeking injunctive relief from
alleged anti-competitive acts and practices by Autoliv. The complaint alleges
numerous unlawful actions taken by Autoliv in connection with a license from
Simula to market and distribute Simula's inflatable tubular structure (ITS)
head and neck side-impact inflatable restraint for automobiles.
The Simula legal action asserts that Autoliv has suppressed technology and
is unlawfully interfering with Simula's rights to market its ITS products to
other first tier automotive safety equipment suppliers and to automobile
manufacturers.
Simula president Don Townsend said, "We regret that Autoliv has failed to
fulfill its obligations to Simula. Unfortunately, in the ordinary course of
business, litigation is sometimes a necessary step to protect the best
interest of a company and its shareholders. In this case we also feel
compelled to act in the interest of the safety of the public.
"Townsend said, "We continue to work with a number of other major first
tier suppliers and customers interested in the ITS. The facts will show that
Autoliv is interfering with these relationships.
Townsend confirmed that the legal proceedings will not interrupt
production of the ITS for its customers and will not disrupt Simula's joint
development programs being initiated with other first tier suppliers.
Also included in the allegations are charges that Autoliv engaged in
illegal antitrust activities and unlawfully infringed upon Simula's trade
secrets in connection with the development of its own competing product, an
"inflatable curtain" device being marketed by Autoliv, though not yet in
production.
