Usman Law Firm: Chase Auto Finance Corporation sued for repossessing a car that was already paid off
MADISON, Wis., June 28, 2017 -- Usman Law Firm and DeLadurantey Law Office have filed a lawsuit in the U.S. District Court, Western District of Wisconsin, Case No. 17-cv-00236 on behalf of Dane County residents Ron and Teresa Olstad, alleging they were victims of the illegal taking of their car.
In the complaint filed in March 2017, the defendants – Chase Auto Finance Corporation, Tri-State Recovery, and Primeritus Financial Services – are charged with violating several provisions of the Wisconsin Consumer Act and the Fair Debt Collection Practices Act.
The suit states the defendants repossessed the Olstad's vehicle – even though it was completely paid for and the Olstads had a clear title in their hand. The Olstads allege that during their protest to the repossession, they even went with the repossession agents to a Chase Bank branch. They contend the branch manager turned a blind eye to their paperwork and said their car could be taken.
"This is yet another example of big banks trampling the rights of consumers. Like millions of other Americans who have worked hard to pay off debts, [the] Olstads have in turn suffered abuse at the hands of the Defendants," said Zeshan Usman, of Usman Law Firm, a Madison consumer protection law firm. "They paid off their car and did not deserve to be publicly humiliated by the defendants' illegal taking of their vehicle."
After the suit was first filed in March, the defendants filed a motion to compel arbitration. "It is clear the Defendants want to hide their actions from the public, which is why they are trying to force the Olstads into arbitration," said Heidi Miller, of DeLadurantey Law Office, a Milwaukee consumer protection firm. "Arbitration happens behind closed doors, without a jury, without the ability for the public to monitor the actions of the banks that took their tax dollars in the bailout. The defendants in this case need to be held accountable, in a court of law, not behind some closed door in private arbitration."
The defendants maintain that the now-complete contract between Chase and the Olstads requires that the dispute with all defendants proceed in private arbitration. If the case proceeds in arbitration, no jury will ever be given an opportunity to review the case.
The complaint filed by Usman Law Firm and DeLadurantey Law Office requests a jury trial seeking actual and punitive damages.
