DefensTech International Inc. Takes Action to Protect Its Intellectual Property Rights; Manufacturer of Ballistic-Resistant and Blast-Mitigation Products Suing Companies Involved in the Repair of the Pentagon
SANTA ANA, Calif.--Dec. 1, 20053, 2005--DefensTech International Inc. filed lawsuits today in the United States District Court for the Central District of California, and the Superior Court of the State of California, for the County of Orange, seeking to enforce its patent and other intellectual property rights against infringement by Line-X Franchise Development Corporation, Line-X Distributing, LLC, and Weidlinger Associates, Inc.DefensTech develops, manufactures, and sells blast-, projectile-, and ballistic-resistant applications and products. The Santa Ana-based company's products include, among others, Defend-X(TM) ballistic- and projectile-resistant doors for police vehicles, ballistic-resistant body armor, blast-resistant trash containers, and blast-resistant building coatings.
DefensTech's lawsuit filed in U.S. District Court alleges that the two Line-X companies and Weidlinger Associates have infringed a patent owned by DefensTech in connection with their work on the repair of the portion of the Pentagon building damaged in the September 11, 2001, terrorist attacks.
According to the complaint, U. S. Patent No. 6,806,212 B2 grants DefensTech exclusive rights to a composite coating and method of application of the coating for reinforcing structures to increase the strength of the structure and its resistance to explosion, ballistics and projectiles, earthquakes, and other traumatic forces. The suit also alleges that the Line-X companies and Weidlinger are also guilty of deceptive practices and advertising. The Line-X companies are based in Santa Ana; Weidlinger Associates is headquartered in New York City with offices in Los Altos and Santa Monica, Calif.
The lawsuit filed in Orange County Superior Court alleges that the Line-X companies and their principals, Jorge Burtin, Claudio Burtin, and Scott Jewett, are engaged in further infringement relating to DefensTech's products covered by patents pending registration by the United States Patent and Trademark Office. Among other claims, DefensTech alleges that its rights have been violated by the Line-X companies' marketing and sale of ballistic-resistant panels for use in police cars, military vehicles, and body armor.
"The filing of these two actions implements a significant decision by DefensTech to aggressively enforce its intellectual property rights," said George C. Rudolph of Stephan, Oringher, Richman & Theodora in Costa Mesa, who represents DefensTech in both lawsuits. "Others contemplating misappropriation of DefensTech's products, processes, and marketing tools should take note that DefensTech is committed to taking whatever legal action is necessary to protect and preserve its rights."
