Active8media Files Suit against Publishing Giant Advance Magazine Publishers

ATLANTA--June 13, 2005--Activ8now, and its operating company, Active8media, announced today that they have filed suit in United States District Court for the Northern District of Georgia for patent infringement and trade secret misappropriation against Advance Publications, Inc. and Advance Magazine Publishers, Inc., doing business as Conde Nast, the publisher of Vogue magazine and Conde Nast Traveler magazine. The suit seeks an accounting from Conde Nast for damages in an unspecified amount.

According to the suit, Activ8now, which owns several patents for providing interactive electronic versions of magazine advertisements, and Conde Nast entered into a license agreement to use Activ8now's patented technology for the September 2004 issue of Vogue magazine. The suit alleges that Conde Nast subsequently contracted with New York-based RichFx, Inc. to "activate" advertisements for the March 2005 issue of Vogue and the May 20, 200505 issue of Conde Nast Traveler. Upon investigation, Activ8now determined that Conde Nast and RichFx copied Activ8now's patented technology for both Conde Nast issues.

The suit also charges that Conde Nast breached its duty of confidentiality by disclosing Active8media's confidential information and trade secrets to RichFx.

"As specified in the complaint, we believe that Activ8now's patents have been infringed," said Dale Lischer, head of the Intellectual Property section of Smith, Gambrell and Russell, the Atlanta law firm representing Activ8now and Active8media. "Activ8now's patents have been successfully enforced before, and we will aggressively defend our client's patent rights again in court."

According to Tom Florio, Vogue's publisher and vice president, the September 2004 issue, which utilized Active8media's technology, was the most successful issue in Vogue's 112 year history. Vogue added approximately 194 additional advertising pages over the September 2003 Vogue issue, and in all, over $60 million in revenue was generated from that issue alone. Florio further lauded the technology on CNBC as "completely new" and stated that the technology was the "engine" behind the success of Vogue's September 2004 issue.
