Remy International Prevails in U.S. Patent Infringement Lawsuit
ANDERSON, Ind., May 16, 2005 -- Remy International, Inc. has prevailed in its patent infringement lawsuit against Evensen Enterprises, Inc. of Mira Loma, California. The case against Evensen in the U.S. District Court for the Southern District of Indiana in which Remy asserted infringement of various patents related to the GM-Remy automotive alternator technology was resolved by a settlement agreement between the parties.
Pursuant to that agreement, Evensen has certified that, by virtue of the sale of its Orange County Alternators business to BBB of Mobile, Alabama, on June 4, 2004, Evensen ceased all infringing activity with regard to Remy's alternator and starter patents and has made a payment to Remy for past infringement. BBB has agreed to stop selling alternators and starters which infringe the Remy Patents and to purchase future related products from approved Remy supply channels. In return for Evensen's certification and payment, Remy dismissed its claims against Evensen.
In a separately negotiated agreement with Remy, BBB has agreed to stop selling alternators and starters which infringe the Remy Patents and to purchase future related products from approved Remy supply channels. Additionally, BBB has also made a payment to Remy for past infringement.
The Indiana lawsuit is still pending against two other accused infringers: Machinery Components, Incorporated, located in West Chicago, Illinois and United Starters and Alternators Industries, Incorporated of Bayshore, New York. The lawsuit is part of what is expected to be a series of legal actions, which Remy, formerly known as Delco Remy, is filing against companies producing similar products containing unauthorized proprietary technologies owned by Remy. To date, each infringement claim has been resolved to the benefit of Remy.
