Remy Files Patent Infringement Lawsuit Against Three More Companies

Company asserts violations of patents by foreign producers with US outlets

ANDERSON, Ind., Dec. 8 -- Remy International, Inc. has filed a lawsuit against three companies, alleging U.S. Patent law violations of Remy's proprietary intellectual property associated with alternators. Orange County Alternator (OCA) located in Mira Loma, California, Machinery Components, Inc. (MCI) of West Chicago, Illinois, and United Starters & Alternators Industries, Inc. (USA Industries) based in Bay Shore, New York, have been named as co-defendants in the suit filed by Remy on November 17, 2004 in the United States District Court for the Southern District of Indiana, Indianapolis Division.

Remy's court action claims that these companies have not complied with prior Cease and Desist notifications and continue to knowingly manufacture, use, sell, offer for sale and/or import to the United States various unlicensed alternator products that use Remy's patent-protected technology and thus infringe Remy's patents. Remy is seeking a judgment ordering the recall and destruction of the defendants' infringing products, as well as damages and injunctive relief.

This action follows a related lawsuit which Remy filed in November 2003 against other companies engaged in knockoff production/distribution activities. Just last month, Remy's patent position was validated relative to Unipoint of Taiwan as the two companies reached a settlement of that earlier lawsuit.

The Motor and Equipment Manufacturers Association (MEMA) estimates that counterfeit and patent-infringing replacement automotive parts are costing the global automotive industry approximately $12 billion annually. As an active member of the MEMA Brand Protection Council, which focuses on combating counterfeiting and preserving intellectual property rights, Remy joins a growing list of major manufacturers taking a proactive position to ensure consumer confidence.
