JHT Holdings, ATC Leasing File Patent Infringement Lawsuit Against Swift Transportation Corporation

Lawsuit Alleges Phoenix-Based Swift Illegally Using Equipment and Technology

KENOSHA, Wis., Aug. 25 -- ATC Leasing Company LLC and its parent, JHT Holdings, Inc., today said they have filed a patent infringement lawsuit against Phoenix-based Swift Transportation Corporation, alleging that Swift is illegally using two patents covering truck hauling equipment known as "boom saddles."

In a lawsuit filed in Wisconsin's Eastern District federal court, JHT and ATC are seeking unspecified damages and an injunction forbidding Swift from using the patented "boom saddle" technology.

Separately, JHT also advised the head of Volvo Logistics, North America, Inc. that the lawsuit has been filed because it alleges Swift is improperly using the equipment to deliver Volvo trucks.

"We must take all necessary steps to protect our valuable intellectual property," said Cletus R. Willems, Vice President and General Counsel for JHT Holdings, Inc.

"Our companies have a responsibility to protect our patents and our reputation in the marketplace as an innovator," Willems added. "That includes taking steps to prevent improper use of our technology."

The complaint claims that Swift is not licensed or authorized to make or use products covered by the two patents. The complaint also alleges that Swift is using the patented technology to compete directly against ATC and JHT.

"We have argued that unless this improper activity is halted, our companies are at a competitive disadvantage. We are prepared to do what it takes to protect our innovative technology," said Willems.
