GoPed(R) Wins First Round in Chinese Trade War

Nevada-Based Manufacturer Successfully Fights Unfair Trade Practices in Importation of Motorized Scooters

MINDEN, Nev., July 8 -- A Federal District Court Judge in Reno, Nevada, has enjoined motorized scooter manufacturers in the People's Republic of China, Taiwan, and Korea, from exporting knock off copies of GoPed(R) brand scooters into the United States. In March, Patmont Motor Werks, Inc., the Nevada-based manufacturer of GoPed(R) motorized scooters, filed a federal suit charging the Chinese Government and an association of Chinese companies with Unfair Trade Practices and Conspiracy to Restrain Trade under the Anti-trust laws.

Judge Howard McKibben also enjoined the importation of scooters from China, which are allowed U.S. entry at zero duty while the People's Republic of China imposes a 167 percent duty and tax on American made products of similar function and design. Attorneys for the successful Plaintiff were William J. Raggio of Vargas and Bartlett, and William D. McCann, General Counsel of the GoPed(R) Group of Companies.

"The manifest unfairness of allowing deceptive, poor quality, noisy, polluting and unsafe imitations of our products to come into the USA duty free has at last been corrected. By entering our country at zero percent duty, this situation had been causing great harm to American jobs and a viable means of alternative transportation," concluded Patmont.
