Claria Corp. Wins Injunction Against Hertz

REDWOOD CITY, Calif., March 31 -- Claria Corporation, a leader in behavioral marketing, today announced that the company was granted a preliminary injunction against The Hertz Corporation's German subsidiary, Hertz Autovermietung GmbH, from the Regional Court of Duesseldorf, Germany.

Last week Hertz announced that it had been granted an initial injunction against Claria with respect to its display of advertisements. The German court issued this injunction through an ex parte process, by which injunctions can be granted solely based upon one side's arguments. Claria was given no opportunity to be heard by the German court or to contest the injunction. Because Hertz made public statements concerning the ruling, which is prohibited under German law, Claria utilized the ex parte process to prevent Hertz, a former client of Claria, from making such public statements.

"Hertz is claiming that the same kind of advertisements that they earlier hired Claria to display on Hertz's behalf now constitute an unwarranted intrusion," stated Jeff McFadden, CEO of Claria Corporation. "We are pleased that the Regional Court of Duesseldorf granted our plea to enforce the sanctity of the law and prevent Hertz from making public statements concerning this matter until both parties are heard by the court."

The Regional Court of Duesseldorf ruled that Hertz is subject to a $300,000 fine or six months jail for their Managing Director each time they violate the injunction.
