Transmission Patent Infringement Rehearing Denied

TROY, Mich., May 14, 2003 -- ArvinMeritor, Inc. announced today that the Court of Appeals for the Federal Circuit (CAFC) denied Eaton Corp.'s petition for a rehearing in the patent infringement lawsuit against the company. The original ruling of the CAFC, in which ArvinMeritor won the lawsuit, still stands.

As stated in ArvinMeritor's original press release dated April 3, 2003, the CAFC found that ArvinMeritor did not infringe on the patent. Eaton's claim was against ArvinMeritor's ZF Meritor Engine Synchro Shift(TM) (ESS) transmission system.
