HUH?-BorgWarner No Longer Produced Turbocharger That Was Subject of Honeywell Infringement Claim
CHICAGO, April 11 BorgWarner Turbo Systems today announced that it decided earlier this year not to contest Honeywell's allegation of patent infringement directed toward a BorgWarner Turbo Systems variable turbine geometry (VTG) turbocharger. BorgWarner Turbo Systems said the decision was made because this turbocharger, based on acquired technology, was no longer produced. BorgWarner Turbo Systems' current production of variable geometry products and customers' use of these products in a variety of applications, are not affected by this decision.
BorgWarner Turbo Systems began shipping its proprietary second generation VTG turbochargers in September of 2001. ``Customer response to this turbocharger has been very positive,'' said John F. Fiedler, Chairman and Chief Executive Officer, BorgWarner Inc. ``We are rapidly gaining market share in this important technology so I can understand why Honeywell is concerned.''
The company believes that current and future variable geometry designs and products will provide customers with the full benefit of new, proprietary technology. The company will vigorously defend its position and will continue to meet customer commitments.
