Lumileds and United Epitaxy Company Settle Litigation

    SAN JOSE, Calif.--Aug. 30, 2001--Lumileds Lighting, Agilent Technologies (a former business group of Hewlett-Packard), and United Epitaxy Company announced today the settlement of the pending litigation among the companies. The allegations and counter allegations centered on United States Patent No. 5,008,718, which is now owned by Lumileds. Although the exact terms of the settlement were not disclosed, the parties have agreed to dismiss all claims and counterclaims asserted against each other.
    In a separate but related agreement, Lumileds has granted United Epitaxy Company a license under several patents. United Epitaxy Company has agreed to pay a license fee and royalties in undisclosed amounts.
    "We are pleased that United Epitaxy Company recognizes the value of our intellectual property. If Lumileds desires to outsource absorbing substrate AlInGaP production in the future, we would consider using United Epitaxy Company as a supplier," said Mike Holt, Lumileds' chief executive officer. "We will continue to advance our patent portfolio in these areas and to lead the industry in the delivery of exciting and cost-effective lighting solutions."
    United Epitaxy Company's chairman of the Board, Dr. Kuo-Hsin Huang, stated, "We are pleased to reach an agreement in resolving the pending litigation. We're also happy that as part of the settlement, Lumileds has agreed to consider partnering with United Epitaxy Company as a contract manufacturer for certain Lumileds products. United Epitaxy Company will benefit in the expanding LED market from this patent license and a possible business partnership. We think this is a win-win settlement for both parties."
