Business Loses Sales Tax Permit
ST. PAUL, Minn., June 4 The Minnesota Department of
Revenue recently revoked the sales tax permit of a St. Cloud business. The
department revoked the permit for failing to pay state sales tax.
Robert A. Schmidt, doing business as Division Amoco, 2400 W. Division St.,
owns an Amoco station that sells gas, convenience items and auto repair
services. The department alleges this business owes the state more than
$46,000 in sales tax, penalty and interest. According to revenue officials,
Schmidt entered into a payment agreement with the state; however, the
agreement was breached when monthly payments were not made.
Minnesota sales tax is a "trust tax." Customers who pay sales tax trust
and expect businesses to send it to the state on their behalf. It must not be
used by a business as additional operating capital or for any other purpose.
If a person or company makes taxable retail sales in Minnesota after
revocation of a Minnesota sales tax permit, the action is considered a felony
under Minnesota law.
