SMX Corp. Obtains Preliminary Injunction, Other Relief

    BOCA RATON, Fla.--April 2, 2001--SMX Corp. (OTC:SMXP) announced today that on March 26, 2001, it obtained a Preliminary Injunction and Other Relief in the United States District Court for the Southern District of Florida. Under the terms of the injunction, to which the defendants consented, the defendants assets are frozen for the protection of SMX and a constructive trust has been imposed over the assets of the Defendants where located or distributed. "We are pleased with the outcome of the proceedings," said Barton S. Sacher, lead attorney for SMX.
    The company licenses and sells NASCAR logo merchandise and also has a large collection of archival photos of NASCAR drivers, including the late Dale Earnhardt. "During the interim order, SMX will utilize the asset inventory during the height of the NASCAR racing season. We are working closely with the team at SMX and independent sales representatives to continue to execute its business plan," said Mr. Sacher.
