Car Safety Ratings vs. Real-World Crashes: What NHTSA and IIHS Scores Don't Tell You About Liability

When you're shopping for a new vehicle, safety ratings from the National Highway Traffic Safety Administration (NHTSA) and the Insurance Institute for Highway Safety (IIHS) are among the most trusted benchmarks available. How Safety Ratings Are Generated

NHTSA's 5-Star Safety Ratings program evaluates vehicles through standardized crash tests: frontal barrier impacts, side barrier impacts, and pole impacts at specified speeds and angles. Each test uses instrumented crash dummies under controlled laboratory conditions designed to replicate common crash scenarios.

The IIHS runs a parallel battery including small and moderate overlap frontal tests, side impacts, roof crush, and headlight performance evaluations, plus vehicle-to-vehicle collision avoidance testing.

Both programs have demonstrably improved vehicle safety. Modern vehicles are structurally superior to those produced a generation ago. But a controlled test environment and the open road are fundamentally different places, and the gap between them is where liability actually lives.


What the Ratings Don't Capture

Safety ratings are built around specific, repeatable conditions that real crashes routinely violate:

Speed above test thresholds. NHTSA frontal crash tests are conducted at 35 mph. Real-world highway collisions frequently occur at 60 to 80 mph, where kinetic energy and injury severity increase dramatically. A five-star performance at 35 mph doesn't extrapolate to a five-star outcome at interstate speeds.
