American Salvage Pool Ass/CCC Info Services, Inc. Lawsuit Update

7 October 1998

American Salvage Pool Association/CCC Information Services, Inc. Lawsuit Update
GLENDALE, Ariz., Oct. 6 -- The American Salvage Pool
Association (ASPA) announced today that its pending lawsuit with CCC
Information Services, Inc. (CCC) has been consolidated with a related case
previously pending in the Circuit Court of Cook County, Ill., and these
combined cases will now proceed toward a May 1999 trial date before a federal
court in Chicago.
Commenting on reports that the ASPA/CCC litigation had terminated, ASPA's
President, Doug Owens stated that the parties "are actively involved in the
discovery phase of this case with depositions to commence in the near future."
Owens further commented that "recent reports suggesting that the ASPA/CCC
lawsuit has ended are utterly without foundation and ASPA remains confident
that it will ultimately prevail on each of its claims against CCC following a
full hearing on the merits."
ASPA filed its counterclaim for damages and declaratory and injunctive
relief against CCC following CCC's initial lawsuit against ASPA in December
1997. The ASPA/CCC litigation arose out of a 1988 contract between the
parties that enabled CCC to deliver the ASPA Salvage Value (ASV) product to
the auto insurance industry. As part of the contract, CCC agreed to limit its
use of the data it obtained from ASPA members to the ASV product and to
refrain from competing against ASPA and its members throughout the duration of
the contract and for a period of five years thereafter. The contract
terminated at the end of 1997. ASPA's counterclaim seeks enforcement of
the contract's non-compete covenant, and significant monetary damages
resulting from CCC's alleged misuse of ASPA data.
Owens assured ASPA insurance industry customers that the litigation will
not cause any disruption in the longstanding quality service delivered by ASPA
members and added that "ASPA remains committed to resolving the lawsuit
without needlessly embroiling its customers in the dispute."
ASPA, which is headquartered in Glendale, Ariz., represents the only
national association of auto salvage pool businesses in the United States and
Canada. Insurance companies are the primary source of salvage vehicles for
ASPA members.
