CART announced that it has filed a lawsuit that seeks a ruling to confirm its right to use the IndyCar name and logo. The suit is a response to a letter from the Indianapolis Motor Speedway in which the speedway claimed ownership of the term IndyCar and requested that CART desist from using it.
According to CART, they adopted the service mark in 1991 and filed for trademark protection at that time. CART asserts they assigned the trademark application to the Indianapolis Motor Speedway after signing a long term licensing agreement with the Speedway in 1992. CART says that they retained the exclusive right to use the IndyCar name and logo.
CART believes that it has fulfilled all of its requirements under the agreement with the speedway, and that the attempt to terminate its right to use the IndyCar name and logo is without merit.
CART asserts that it is in the best interest of all concerned to secure a timely ruling on the trademark dispute. Many sponsors, promoters, teams, licensees, etc., presently using the IndyCar mark.
No hearing date has been set, although a judge has been assigned to hear the matter.
