WASHINGTON--August 18, 2012:Global Automakers says that itis disappointed with today's decision by the U.S. Court of Appeals for the D.C. Circuit to dismiss the petitions challenging the U.S. Environmental Protection Agency partial waiver permitting gasoline with 15 percent ethanol (E15) in 2001 and newer model vehicles.
The statement reads as follows: "We disagree with the court's finding that automobile manufacturers do not have standing to challenge an agency action that permits the use of a fuel, such as E15, in automobiles not designed or warranted for such use. However, we are pleased that the dissent found that we would have won on the merits of the case and view the majority's ruling as a temporary legal setback.
Global Automakers supports the prospective use of alternative fuels, including ethanol. We believe before E15 or any new alternative fuel is introduced into the marketplace that comprehensive, independent, and objective scientific testing must be completed to ensure that the fuel will not harm the public by increasing air pollution, harming engines, or endangering consumers and that there are adequate protections in place to prevent misfueling.
We are currently evaluating further legal options in the litigation."
