Is Your Vehicle a Lemon? Here’s How to Get a Refund or a Replacement Vehicle

CHICAGO--The term “lemon” has long been used to describe a vehicle that has ongoing problems. No matter how many times the vehicle is taken to a service station to be repaired, the problem never seems to get fixed and new problems keep popping up. Having a vehicle that is a lemon is frustrating and costly. Sadly, many people do not know they do not have to be stuck with a defective vehicle.

There are Federal and State Lemon Laws to protect people if they have the misfortune of purchasing a vehicle that is a lemon. State lemon laws and Federal warranty enforcement laws state if a person purchased a vehicle that has ongoing mechanical problems; the vehicle manufacturer may be responsible for giving that person a refund or a replacement vehicle.

Here are the steps involved in getting a refund or a replacement vehicle for a lemon:

1. The first step is to determine if the vehicle qualifies as a lemon in your state. Every state has slightly different Lemon Laws that describe what factors need to be met for a vehicle to be considered a lemon. 2. Once it has been determined your vehicle may be a lemon, the next step is to contact an attorney who has a record of winning Lemon law cases in your state. 3. The final step is for the attorney to file your lemon law suit. It will take approximately 1-2 months to receive a judgment if the manufacturer is responsible for providing you with a refund for the current value of your vehicle or has to provide you with a replacement vehicle of the same make and model.
